TERMS OF TRADE & EXPORT INFORMATION

Basic Terms of Trade

MACHINERY CONDITION
eMarkets Co. is not an equipment retailer. We trade and export at the wholesale level primarily to experienced machinery dealers. Although from time to time we provide equipment to private users, all customers must understand the following:

eMarkets sells & exports its goods in AS IS CONDITION. This means the goods are sold in their current condition and without warranty. Goods acquired by eMarkets are thoroughly inspected and tested by trained personnel. The overall condition, basic functionality of parts and any major defects will be reported and available to customers. Additional photos and quality checks can be conducted by eMarkets upon request to ensure that our customers have an accurate picture of the machine prior to purchasing.

eMarkets Co. recommends basic servicing and reconditioning in some cases, be performed to ensure the safe operation of the machine.

EXPORT & IMPORT
eMarkets can arrange all Japan-side logistics and Japan-side export procedures. Depending on the agreed deal term (described below), we can handle equipment export until the equipment is delivered to the customer's destination port or location.

It is the customers responsibility to understand the importing country's import regulations. Import regulations and restrictions vary from country to country. If equipment shipped by eMarkets is rejected by the importing country's custom authority for any reason, eMarkets reserves the right to seize the customer's deposit in order to cover return shipment expenses and any other loss/damages.


PRICING & DEAL TERMS
eMarkets will offer its prices on a per inquiry basis. Customers can use our inquiry form in our website or contact us directly by email or phone. eMarkets can quote prices within any of the following deal terms:

EX YARD - machine price as is in our stock yard
EX GO PORT - machine price + transportation fees to the specified port in Japan
FOB - machine price + trans. fees + shipment handling fees + Japan export/customs fees
C&F - FOB deal term + ocean freight to your port
CIF - FOB deal term + ocean freight + marine insurance

Customer's import duties/taxes, any importing country port/entry fees, or any other fees incurred in the importing country is not the responsibility of eMarkets and are not included in any quotations given by us. The customer should contact their local customs agent for information.

* Other logistics fees such as special machine washing, extra in-land transportation costs, container vanning, equipment dismantling etc., if required by the customer, will incurr extra fees that will be added to the FOB price of the machine.
* FOB term requires the customer to pay ocean freight at the destination port.
* Domestic purchases (EX YARD or EX GO PORT) will incurr a 5% Japanese consumption (sales) tax.

PURCHASING
Purchasing steps are outlined below:

   1. If a deal is reached, eMarkets will issue a proforma invoice.
   2. The customer must pay a deposit of at least 50% of the order total (down payment)
   3. eMarkets will ship the purchased goods and provide evidence of shipment
   4. The customer must pay the balance at least 5 business days prior to arrival of equipment
   5. eMarkets will dispatch necessary documents (bill of lading, etc.) by certified courier

eMarkets Co. Ltd. only accepts payments in Japanese yen, US dollar, and European euro. Payments in USD and EURO will be converted to Japanese yen at the prevailing market exchange rate. eMarkets cannot be responsible for changes in the exchange rate, the customer is responsible for paying the full amount as agreed and in the agreed currency.

Payments can be made by T.T. (telegraphic transfer) or irrevocable L/C* at sight (letter of credit). eMarkets only accepts payments by L/C for purchases over 1,000,000 YEN. Personal checks and credit cards are not accepted.

*We cannot accept letter of credit from certain countries.

Order Cancellation Information - eMarkets does not accept any order cancellations. In the event of an absolutely necessary cancellation, eMarkets reserves the right to sieze part or all of the customers deposit to cover loses or re-stocking expenses. If a customer cancels before a deposit is made, eMarkets may require a cancellation fee.


DELIVERY
For shipment, machinery can be loaded in 20ft/40ft/FLAT marine containers or loaded individually (ro-ro or lo-lo freight). eMarkets works with the leading shipping companies in the industry. Our shipping department can provide competitive freight quotations to almost any part of the world.

Shipment schedules and freight rates change all the time---eMarkets cannot be responsible for unavoidable delays/shipment cancellations. We will try in best-effort to secure the most convenient shipments for our customers.

eMarkets Co. can ship most all types of machinery.


PARTS SUPPORT
eMarkets will provide unlimited parts support for goods purchased from eMarkets. However support is not guaranteed due to difficult to find or discontinued parts for older/rarer machines. High quality aftermarket parts (U/C & perishable parts) are also available.
